ABSTRACT

The Executive Branch has taken unprecedented actions to test the limits of the separation of powers through attempting to dismantle departments created by Congress through mass firings, cancelling Congressional appropriations to universities and other entities, and, in some instances, defying orders by the lower courts. Traditional rules of federalism are also being tested as the Trump Administration deploys the National Guard into cities in democratic states in opposition to the governors of those states.
